Best Music Coach is a music education platform connecting students with experienced music instructors. Our platform makes learning music accessible, engaging, and effective by offering close online collaboration between instructors and students. We value real-world musical expertise and the personal growth that comes from learning an instrument. It should be expressly noted: Best Music Coach is NOT a traditional educational institution and is not intended to operate as such. Our mission is to help students develop their musical skills through online instruction, lessons, and coaching. This is the purpose of our platform.
Best Music Coach, LLC (otherwise referred to as "Best Music Coach," "we," "us," or "our") is the operator of the Best Music Coach platform. We offer our services through the website located at https://bestmusiccoach.com (the "Website"), and through other means that we deem fit (the Website and all services provided by us shall hereinafter be referred to as the "Services").
These Terms of Use (the "Terms of Use" or this "Agreement") set forth the legally binding terms for your use of our Services, whether you are a "Visitor" (which means you are just accessing and browsing the Website) or a "Subscriber," which means you have paid for any of our offered Services. Visitors and Subscribers are referred to in this Agreement as a "User" or "you."
You shall note that Best Music Coach's collection, use, and disclosure, if any, of information collected from you, is detailed in the Best Music Coach Privacy Policy (published at https://bestmusiccoach.freshdesk.com/support/solutions/articles/69000428817-best-music-coach-privacy-policy). The terms of the Privacy Policy, together with our Rescheduling Policy, Cancellation Policy, Emergency Policy, and Technical Malfunction Policy (each available in our Help Center at https://bestmusiccoach.freshdesk.com), are incorporated by reference and constitute a part of these Terms of Use. Any additional terms, guidelines, and rules that are linked to this Agreement are also incorporated herein by reference.
PLEASE READ THESE TERMS OF USE CAREFULLY, AS THEY CONTAIN AN AGREEMENT REGARDING YOUR LEGAL RIGHTS, REMEDIES, AND OBLIGATIONS.

Your Acknowledgment and Acceptance of these Terms of Use
YOU HEREBY ACKNOWLEDGE AND AGREE THAT THESE TERMS OF USE, AS AMENDED FROM TIME TO TIME AND PUBLISHED AT https://bestmusiccoach.com, INCLUDING OUR PRIVACY POLICY (PUBLISHED AT https://bestmusiccoach.freshdesk.com/support/solutions/articles/69000428817-best-music-coach-privacy-policy) AND OUR OTHER PUBLISHED POLICIES, COMPRISE A LEGAL AGREEMENT BETWEEN YOU AND BEST MUSIC COACH, LLC.
Best Music Coach provides the Services to you, the User, subject to your compliance with these Terms of Use, as well as any other written agreement between Best Music Coach and you.
Although we may attempt to notify you when major changes are made to these Terms of Use, you acknowledge and agree that it is your responsibility to review these Terms of Use from time to time and to familiarize yourself with any modifications. The said modifications will be effective immediately and will apply to disputes in connection with this Agreement from the date of posting forward. Your continued use of the Services after a modification has been made to the Terms of Use constitutes your acceptance of such modification.
General Restrictions
You must be at least 18 years of age to independently create an account and use our Services. Minors between the ages of 10 and 17 may use the Services only through an account created and supervised by a parent or legal guardian, who agrees to be bound by these Terms of Use on the minor's behalf and assumes full responsibility for the minor's participation. We do not knowingly provide Services to anyone under the age of 10.
You may not use the Services in any way that harms Best Music Coach or any other person or entity, and in any way that is prohibited under the applicable law of the jurisdiction in which you are bound by or prohibited by these Terms of Use.
You agree not to capture, modify, edit, copy, sell, license, distribute, publish, adapt, reproduce, or reuse the content from the Website and any Services in any other way for any public or commercial purpose.
Representation of Identity and Academic Integrity
By enrolling in a Best Music Coach course or lesson, you represent and warrant that you are the individual participating in the course and not someone else. You further represent that you are using your true and accurate name for your account and all interactions within the Best Music Coach platform. You commit to upholding the highest standards of academic integrity, which includes not engaging in cheating, plagiarism, or any form of dishonest conduct such as submitting work that is not your own (including submitting recordings of someone else's performance as your own), using unauthorized materials during assessments, or impersonating another individual.
Violation of this clause may result in immediate termination of your account and forfeiture of any course credits or certificates, at the sole discretion of Best Music Coach.
User Account
You need an account ("User Account") for most activities at Best Music Coach, including subscribing and enrolling in a course or lesson program featured on the Website.
You shall note that you must be at least 18 years of age in order to open a User Account in your own name. A parent or legal guardian may open a User Account on behalf of a minor between the ages of 10 and 17 and enroll that minor in lessons or Courses appropriate for them. The parent or guardian assumes full responsibility for the minor's account, activity, conduct, payments, and submissions, and represents that they have authority to bind the minor to these Terms of Use. We do not knowingly create accounts for or provide Services to anyone under the age of 10. If we discover that an account belongs to a person under 10, or to a minor without a supervising parent or guardian, we will terminate the account.
YOU ACKNOWLEDGE AND AGREE THAT SHOULD BEST MUSIC COACH PROVIDE YOU WITH THE ABILITY TO CREATE A USER ACCOUNT, YOU SHALL HAVE NO OWNERSHIP OR OTHER PROPRIETARY INTEREST IN THE USER ACCOUNT, AND YOU FURTHER ACKNOWLEDGE AND AGREE THAT ALL RIGHTS IN AND TO ANY USER ACCOUNT OR USER PROFILE ARE, AND SHALL FOREVER BE, OWNED BY AND INURE TO THE BENEFIT OF BEST MUSIC COACH.
When setting up and maintaining your User Account, you must provide us with complete, true, and actual information (including your email address) and to keep your personal data accurate and up to date at all times. You can always correct or update your personal data. For more information about personal data protection please refer to our Privacy Policy.
You are solely responsible for your User Account and everything that happens on your User Account, including any harm or damage (to us or anyone else) caused by someone using your User Account (with or without your permission). You should take all necessary steps to ensure that your password is kept confidential and secure, and you shall inform us immediately if you have any reason to believe that your password has become known to anyone else, or if the password is being, or is likely to be used, in an unauthorized manner.
You can delete your User Account by sending an e-mail request to our Support Team at lessons@bestmusiccoach.com. Please note that if you request the deletion of your User Account, you might not be able to further access and use the Services, as well as any content that you submitted to us.
Best Music Coach does not, and shall not, recognize the transfer of your User Account or user profile. Therefore, you may not give, purchase, sell, bargain, barter, market, trade, offer for sale, sell, license, assign or otherwise divest your rights, responsibilities or obligations under this Agreement, either in whole or in part, without the prior written consent of Best Music Coach. Any attempt to do so shall be void and of no effect.
Instructor Conduct and Lessons Involving Minors
Some of our instructors interact with students who are minors. We take this responsibility seriously and require all instructors to maintain professional, age-appropriate conduct at all times. Instructors agree to a code of conduct that prohibits harassment, abuse, exploitation, romantic or sexual contact or communication, requests for personal information unrelated to instruction, contact with minors outside the Best Music Coach platform, gift-giving, and any other behavior inconsistent with a professional educational relationship.
Parental Supervision. For any student under the age of 18, the supervising parent or legal guardian:
- is solely responsible for evaluating the suitability of any instructor and Course for the minor;
- is strongly encouraged to be present, within earshot, or otherwise actively supervising during live one-on-one lesson sessions, particularly when video is enabled;
- is responsible for ensuring the minor uses appropriate safety practices, including ergonomic setup, hearing protection, and reasonable practice durations; and
- agrees that the minor will use only the supervising adult's User Account and will not create a separate account.
Reporting Concerns. If you observe or experience any conduct by an instructor or other User that you believe is inappropriate, unsafe, or that violates this Agreement, please report it immediately to lessons@bestmusiccoach.com. We will review reports promptly and may suspend or terminate accounts pending investigation.
No Guarantee of Background Screening. Except as expressly stated in writing by Best Music Coach, we do not represent that any instructor has undergone a background check. Parents and guardians are encouraged to make their own assessment of any instructor before enrolling a minor.
Course Enrollment
Under agreement with our instructors, we have been granted the right to offer online courses, lessons, and coaching programs (each a "Course") to our Users and to present the Course to those Users who enroll in it. You should note that the Content of the Course belongs to the instructor and to Best Music Coach, and is under no circumstance transferred or assigned to you by virtue of your enrollment.
For the purposes of this Agreement, the term "Content" means objects of intellectual activity and equivalent means of individualization, including: literary works, texts, lectures, presentations, speeches, computer programs, mobile programs and applications, sheet music, tablature, chord charts, backing tracks, exercise materials, as well as audio and visual works (video courses, infographics, phonograms, images, trademarks and service marks), commercial designations and trade names, trademarks, logos, hypertext links, including fragments thereof, information, widgets, and any other objects or materials published on the Website and within the Course.
When your enrollment in a Course is confirmed and provided that all the fees associated with the Course have been paid in full, we grant you the right to view the Course via the Website. Courses are licensed but not sold to you. In legal terms, this means that we grant you a limited, personal, non-exclusive, non-transferable license to access and view the Courses (and associated Content) via our Website, solely for your personal, non-commercial, informational purposes, all in accordance with these Terms of Use and any conditions or restrictions specifically associated with such particular Course. All other uses are expressly prohibited.
The right to view the Course does not give you any right to download, record, resell, or distribute the Course in any manner. This includes, but is not limited to, sharing your User Account information, illegally downloading the Course, recording any part of the Course using screen capture technology or any other recording methods, and sharing the Course content in any form. You are expressly prohibited from reproducing, redistributing, transmitting, assigning, selling, broadcasting, renting, sharing, lending, modifying, adapting, editing, creating derivative works of, sublicensing, or otherwise transferring the Course or any of its parts. All live lessons may be recorded by Best Music Coach and access to these official recordings is provided exclusively to our students via a copyright-protected environment. Any unauthorized recording or distribution of these materials is strictly forbidden and may result in legal action.
We generally give Users who enroll in a Course access to course materials for the duration specified at the time of enrollment, which can be accessed via their User Account. However, Best Music Coach reserves the right, at its sole and absolute discretion, to change this term or to revoke any license. We may also, at our sole and absolute discretion, access and use Courses at any point in time in the event where we decide or are obligated to disable access to a Course due to legal or policy reasons, for example, if the Course that you enrolled in is the object of a copyright complaint, or if we determine its Contents violates any of our policies, agreements or rights.
When you complete a Course, you may receive a certificate of completion, which you can share with your friends, relatives, co-workers and potential employers. Certificates of completion help demonstrate your accomplishments, but you shall note that Best Music Coach is not an accredited institution, and as a result, the certificates cannot be used for formal accreditation.
By enrolling into a Course, you expressly agree that we may collect, use, store and otherwise process your personal data for the purpose of providing you with access to the Course and related activities and communications in which you agree to participate. In order to receive news and additional information about our Courses, as well as other useful information from Best Music Coach, you may be required to provide us with additional personal information. You acknowledge, and agree, that we may collect, use, store and otherwise process your personal information and may share such data with third party service providers for the purposes of improving or providing our Services, subject to our Privacy Policy.
Music Instruction Disclaimers and Assumption of Risk
You understand and acknowledge that learning and practicing a musical instrument or vocal performance involves physical activity that carries inherent risks, including but not limited to repetitive strain injuries, tendonitis, carpal tunnel syndrome, back and neck strain, vocal strain, hearing damage from prolonged exposure to loud sounds, and other physical injuries. By enrolling in any Course, you assume all such risks.
Best Music Coach and its instructors are music educators, not medical professionals, physical therapists, occupational therapists, vocal therapists, or speech pathologists. No guidance offered through the Services constitutes medical, therapeutic, or healthcare advice. If you experience pain, discomfort, hearing changes, voice changes, or any other physical symptoms, you agree to stop the activity immediately and consult an appropriate licensed healthcare professional.
You are solely responsible for using appropriate hearing protection, proper ergonomic setups, taking adequate breaks, and otherwise following safe practice habits. You are responsible for ensuring that your practice environment, instrument, and equipment are safe and in good working condition. Best Music Coach is not liable for any injury, hearing loss, vocal damage, or harm to your instruments or equipment resulting from your participation in the Services.
You acknowledge that musical skill development is highly individual and depends on many factors including but not limited to your prior experience, time invested in practice, natural aptitude, and consistency. Best Music Coach makes no representation, warranty, or guarantee that you will achieve any particular level of musical proficiency, skill, or career outcome as a result of using the Services.
Equipment and Technology Requirements
You are solely responsible for providing and maintaining your own musical instruments, accessories, sheet music, computer hardware, microphones, audio interfaces, webcams, internet connection, and any other equipment needed to participate in the Services. Best Music Coach is not responsible for the quality, suitability, or condition of your equipment, nor for any technical issues arising from your equipment or internet connection.
Music Copyright and User Recordings
Music is heavily protected by copyright. When you submit recordings, videos, performances, arrangements, or other materials to Best Music Coach (whether for instructor review, peer feedback, or otherwise), you represent and warrant that:
- You either own all rights to the underlying musical work and recording, or you have obtained all necessary licenses, permissions, or clearances from the copyright holders (which may include composers, publishers, performance rights organizations, and record labels);
- Your submission complies with all applicable copyright laws including the U.S. Copyright Act and any equivalent foreign laws; and
- You will indemnify and hold harmless Best Music Coach from any third-party claims arising from copyright infringement related to your submissions.
You acknowledge that performing copyrighted musical works for educational purposes within the Services may be permitted under certain fair use or educational use doctrines, but that distributing, publishing, monetizing, or publicly performing such recordings outside the Services may require separate licensing.
DMCA Notice and Takedown
Best Music Coach respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act ("DMCA"). If you believe that any content available through the Services infringes your copyright, please send a written notice to our designated DMCA agent at lessons@bestmusiccoach.com that includes:
- A physical or electronic signature of the copyright owner or person authorized to act on their behalf;
- Identification of the copyrighted work claimed to have been infringed;
- Identification of the material claimed to be infringing and information sufficient to locate it;
- Your contact information;
- A statement that you have a good-faith belief that the use is not authorized; and
- A statement, under penalty of perjury, that the information is accurate and that you are authorized to act on behalf of the copyright owner.
We may terminate the accounts of repeat infringers in appropriate circumstances.
Changes in Courses
Our first priority is to provide you with quality Courses, but unexpected circumstances do sometimes occur. We reserve the right to reschedule, modify, or even cancel any offered Courses, or make changes in the Course's agenda, including substituting instructors when necessary. Please note that in this regard our Services are subject to the Disclaimers and Limitation of Liability sections below.
Your Participation in a Course
We may provide you with the opportunity to post comments, upload your work, submit recordings, and other content in Course groups and on social media (the content that you submitted shall be referred to as your "User Comment"). The User Comments are intended to initiate discussions and facilitate learning. When you elect to post a User Comment, you retain all ownership rights in and to your User Comments, but grant us an irrevocable, perpetual, non-exclusive, fully paid-up, royalty-free, transferable, sublicensable, worldwide license to copy, distribute, modify, create derivative works based on, publicly perform, publicly display, and otherwise use such User Comment.
You are fully responsible for all the User Comments that you post on our Website or throughout the Courses (whether in our Website or in other social media platforms). We reserve the right to remove or modify your User Comments for any reason, including User Comments that we believe violates these Terms of Use, without liability to you or any third party.
For further details, please refer to the section below titled "Rights relating to your Submitted Content."
When you interact directly with other Users or our instructors, you must be careful about the types of personal information that you share. Best Music Coach does not control what Users and instructors do with the information they obtain from other Users throughout our Courses or otherwise. For your safety, we recommend not sharing your email or your other personal information.
In certain Courses, we enable you to ask the instructor questions and to post reviews. For certain Courses, the instructor may ask you to submit content (including audio or video recordings of your performance) as "homework" or assessments. We encourage you not to submit anything that is not yours.
Fees, Subscriptions, and Auto-Renewal
Best Music Coach offers Courses, lesson packages, and recurring subscription plans for a fee. By subscribing for a Course or service, you are deemed to have agreed to the pricing, payment, and billing policies applicable to such fees and charges as described on the Website or in any policy of a third-party payment service. By proceeding with payment, you authorize us to charge your debit or credit card (or process other means of payment) for the full fee applicable for your selected Course or subscription, whether in a one-time payment transaction or in multiple split payments according to an approved payment plan or recurring subscription.
Recurring Subscriptions and Automatic Renewal
THIS IS AN AUTOMATIC RENEWAL / CONTINUOUS SERVICE OFFER. PLEASE READ CAREFULLY.
When you enroll in any subscription plan offered by Best Music Coach, you agree and acknowledge that:
- Recurring Charges. Your subscription will automatically renew at the end of each billing period (e.g., monthly, quarterly, or annually) and Best Music Coach (through our payment processor) will automatically charge the payment method on file at the then-current subscription rate plus any applicable taxes and fees, without any further action by you, until you cancel.
- Length of Term and Frequency. The length and frequency of each renewal period are the same as the initial term you selected at checkout (for example, a monthly plan renews every month). The specific term and amount are disclosed to you at the point of sale and in your purchase confirmation.
- Cancellation Right. You may cancel your subscription at any time before the next billing date to avoid being charged for the following period. Cancellation takes effect at the end of the then-current paid billing period; you will retain access to the subscription benefits through that period, after which access ends.
- How to Cancel. You may cancel (i) through your User Account self-service settings on the Website; (ii) by emailing lessons@bestmusiccoach.com from the email address associated with your account; or (iii) by replying to any subscription confirmation or billing email we have sent you. California residents and any other consumers entitled to it by law may cancel exclusively online through your account or by using the cancellation link we provide in our communications, without having to call us or visit any other location.
- No Refunds for Partial Periods. Except where required by law or expressly provided in our Refund Policy, fees for the then-current billing period are non-refundable and you will not receive a pro-rated refund for any unused portion of the period in which you cancel.
- Price and Material Changes. We may change the price or material terms of your subscription. We will provide you at least seven (7) days' (or more if required by law) advance notice of any such change before it takes effect, via the email address on file. Your continued use of the subscription after the change takes effect constitutes acceptance; if you do not agree, you must cancel before the change takes effect.
- Failed Payments. If your payment method is declined, we may attempt to re-charge it, suspend your subscription, and/or terminate your access until payment is successfully made.
By enrolling in any subscription, you affirmatively acknowledge and accept these auto-renewal terms. The same terms are presented to you at checkout, and we will send you a post-purchase acknowledgment containing these terms and clear instructions for cancellation.
General Payment Terms
You agree to pay all fees or charges incurred by you in accordance with these Terms of Use and the billing terms that are in effect at the time that the fee or charge becomes payable. Please note that as a general rule, payment for the Course to which you subscribed should be made no later than one day before the Course's start date unless you were approved for and have enrolled in a payment plan.
Chargebacks
If you initiate a chargeback or dispute a charge with your card issuer or bank for any payment that was authorized and for which Best Music Coach has provided the corresponding Services (or made the Services available to you), Best Music Coach reserves the right, in its sole discretion, to (i) terminate or suspend your User Account and access to all Services; (ii) recover the disputed amount plus any related processing or chargeback fees; (iii) report the chargeback to credit reporting agencies or collections; and (iv) refuse to provide Services to you in the future. We strongly encourage you to contact lessons@bestmusiccoach.com first if you have any billing concerns; we will work with you in good faith to resolve them before any chargeback is necessary.
If you successfully pass your Best Music Coach course, you may be eligible to receive a certificate of completion. Your certificate of completion will be issued on the condition that you have paid for the course in full. If you have any outstanding amount owing on your account, you must pay the balance in full to receive your certificate.
You acknowledge that Best Music Coach may utilize certain third-party providers (such as PayPal, Stripe, Square, and others) to collect or otherwise process any of such fees and charges. Any additional, separate charges or obligations, including but not limited to currency exchange charges you directly incur with the said third party and your banking institution are your sole responsibility. When you pay for a subscription, you agree not to use an invalid or unauthorized payment method.
THE PAYMENT FOR ANY COURSE IS FINAL (SUBJECT TO OUR REFUND POLICY) AND SHALL UNDER NO CIRCUMSTANCES BE TRANSFERABLE OR EXCHANGEABLE INCLUDING, WITHOUT LIMITATION, UPON TERMINATION OF YOUR USE OF OUR SERVICES FOR ANY REASON OR NO REASON, TERMINATION OF THIS AGREEMENT, AND/OR THE DISCONTINUATION OF THE SERVICES DUE TO YOUR VIOLATION OF THESE TERMS OF USE OR OUR OTHER POLICIES.
Any use of invalid or unauthorized payment methods will allow us, at our sole and absolute discretion, to cancel the payment and your subscription for any Course.
Unless otherwise stated, all fees are quoted in U.S. dollars.
Refund Policy
We understand that sometimes plans change, and we're here to support you. Please read our refund policy below to understand how we can assist you.
For Advanced and Premium Packages — this is our typical Refund Policy:
- Course Cancellation by Best Music Coach: If we need to cancel a course you're enrolled in, we'll issue a full refund of your course fee. We're sorry for any inconvenience this may cause.
- 7-Day Satisfaction Guarantee: If you're not completely satisfied with your course, you can request a full refund within 7 days of the course start date.
For Starter Package Courses:
- Course Cancellation by Best Music Coach: If we need to cancel a course you're enrolled in, we'll issue a full refund of your course fee. We apologize for any disruption to your plans.
- First Session Refund Policy: We value your learning experience and want you to be satisfied with your course choice. If, after attending the first session, you feel the course isn't right for you, you have 24 hours from the end of that session to request a full refund.
Completed Lessons and Completed Courses (No Refund):
- Completed Individual Lessons. Once an individual lesson has been delivered (i.e., the lesson session occurred or you accessed the recorded lesson content for which you paid), that lesson is considered "completed" and is non-refundable.
- Completed Courses. A Course is considered "completed" once it has concluded (or once you have accessed substantially all of its content). Completed Courses are non-refundable outside of the satisfaction-guarantee windows described above.
- Lesson Packages. For multi-lesson packages, refunds (when applicable) are calculated on the basis of unused lessons at the published per-lesson rate; completed lessons within the package are not refundable.
Gift Cards:
- General Rule. Gift card purchases are generally final and non-refundable, and gift cards cannot be exchanged back for cash, except as required by applicable law.
- California Residents (and any state with similar law). California Civil Code § 1749.5 and similar laws in certain other states give consumers specific rights with respect to gift cards: (i) most gift cards sold in California cannot expire; (ii) if a gift card has a remaining cash value of less than ten dollars ($10), the holder may request that the remaining balance be paid in cash or check. We will honor these and any other gift card rights required by your state of residence. To request a cash redemption of an eligible small balance, please contact lessons@bestmusiccoach.com.
- Courses Purchased Using Gift Cards: If a course is purchased using a gift card, the regular cancellation policy applies. However, if a refund is issued due to course cancellation or within the satisfaction guarantee period, the refund will be credited back to the original gift card rather than issued in cash, except where law requires otherwise.
How to Request a Refund:
- Contact Our Support Team: Simply reach out to our friendly Support Team within the applicable refund period. They'll guide you through the process step by step.
- Refund Processing Time: We aim to process all refunds within 10 working days after receiving your request. We'll keep you updated throughout the process.
Important Information:
- Refund Method: Refunds are always made to the original form of payment, i.e., the same credit card used for the initial transaction. If the original credit card is no longer active, the refund will be issued in the form of a gift card credit, which can be used toward future course payments. Please note that cash or check refunds will not be issued in such cases.
- Course Access: Once your refund is processed, you'll be withdrawn from the course, and your access to course materials will end.
- Your Uploaded Materials: Any homework or materials you've submitted will be securely deleted from our systems. We kindly ask that you also delete any course materials you've downloaded.
- Re-enrollment: If you decide to rejoin the course in the future, we'd love to have you back! Please note, however, that you'll need to enroll again as we cannot reinstate access to the previous course session.
Bonus Courses:
- Alternative Options: If you've received a bonus course along with your purchase and it doesn't meet your expectations, please let us know. We'll be happy to help you choose a different bonus course if one is available. Please note that monetary compensation isn't available for bonus courses, and the terms of your main purchased course remain the same.
Exceptions:
- Policy Violations: We strive to create a positive and respectful learning environment for everyone. If your account is terminated or access to a course is disabled due to a violation of our Terms of Use or other policies, we won't be able to offer a refund.

Drop for Non-Payment
Our Drop for Non-Payment procedure is the administrative process by which students are disenrolled from courses when they do not pay their course fees.
- If you are enrolled in a payment plan and have an unpaid balance of less than $100 you will not be dropped from the course, but unpaid balances will result in a hold on your account that prevents you from graduating and obtaining your certificate until the balance is settled.
- If you are enrolled in a payment plan and have a balance due of $100 or more you will be dropped from your course if your balance isn't settled by 9 am EST on the fifth (5th) business day following the original due date of the unpaid installment.
Once you have been dropped from your course, your access to the course materials is terminated, and any homework and materials you have uploaded are deleted. Please note that it is not possible to reinstate your account after being dropped for non-payment — all your homework and other materials will be permanently deleted. If you have been dropped for non-payment, we will not refund any installments made to date as a part of a payment plan unless you are eligible for a refund in accordance with the above-stated Refund Policy.
Transfer Policy
If you have a health or family-related emergency in the first third of the course preventing you from attending the course and you notify the Support Team before class 4, you have the right to request to be moved to the next cohort of the Course (if offered) or in another course of your choice (in case the next cohort is not offered) for a $200 re-enrollment fee. We do not require supporting documentation for your emergency.
If you request transfer in the second third of the Course (typically from class 5 till class 8), you can request to be re-enrolled into the next cohort of the Course (if offered) or in another course of your choice (if the next cohort is not offered) for a $400 re-enrollment fee.
If you request transfer in the last third of the Course (typically after class 9), you can request to be re-enrolled into the next cohort of the Course (if offered) or in another course of your choice (if the next cohort is not offered) for a $600 re-enrollment fee.
You can use this transfer option only once, i.e., if you have been transferred once, you cannot request another transfer.
Scheduling, Rescheduling, and No-Show Policy (Live and In-Person Lessons)
Live lessons (whether online or in-person) are scheduled appointments with a real instructor whose time is reserved exclusively for you. Our detailed scheduling rules are published in our Help Center (see our Rescheduling Policy, Cancellation Policy, Emergency Policy, and Technical Malfunction Policy at https://bestmusiccoach.freshdesk.com), which are incorporated into these Terms of Use by reference. By enrolling in any live or in-person lesson, you agree to those policies, as updated from time to time. Below is a summary of the key principles:
- Student No-Show. If you fail to attend a scheduled lesson without canceling within the required notice window, that lesson is considered delivered and used. You forfeit the lesson with no make-up and no refund.
- Late Arrival. If you are late to a lesson, the instructor is not obligated to extend the session beyond its originally scheduled end time; the lesson still ends at the scheduled time and is treated as delivered.
- Instructor No-Show. If your instructor fails to attend a confirmed lesson without proper notice, you may, at your option, reschedule the lesson at no cost or receive a credit toward a future lesson.
- Rescheduling. Rescheduling is permitted only within the timeframes described in our Rescheduling Policy. Requests outside those windows will be treated as a no-show.
- In-Person Lessons. For in-person coaching, the same rules apply. You are responsible for arriving at the agreed location at the agreed time. If you do not show, the lesson is forfeited. If the instructor does not show, you receive a credit or rescheduled lesson at no cost.
- Emergencies and Technical Malfunctions. Genuine emergencies (yours or ours) and technical malfunctions are handled under our Emergency Policy and Technical Malfunction Policy.
Best Music Coach reserves the right to apply administrative or rescheduling fees as published in the applicable policy.
Your Conduct Through the Services
You are solely responsible for your interaction with other Users (including, for the purposes of this section, the Course instructor), whether online or offline. You acknowledge and agree that Best Music Coach is not responsible or liable for the conduct of any User.
You are solely responsible for your conduct when using our Services and agree that you will not publish, post, upload, transmit, distribute, disseminate or otherwise make available to any User or instructor any:
- material that is harmful, abusive, defamatory, libellous, obscene, infringing, embarrassing, unwanted, invasive of another's right of privacy or publicity, hateful, or racially, ethnically or otherwise offensive, objectionable or otherwise inappropriate as determined by Best Music Coach in its sole discretion;
- material that supports or influences any other acts of criminal activity (including against humans, animals, and property);
- material or information that infringes any copyright, trademark, patent, trade secret, privacy, publicity, or other right of others (including unauthorized recordings of copyrighted musical works);
- files that contain any malicious code, including viruses, spyware, Trojan horses, worms, time bombs, cancelbots, corrupted data, or that may in any way damage or interfere with the operation of the Website and Services, other Users' and instructors' access to the Website or Services and/or Users' and instructors' computers;
- material that includes pornographic images or text, or which otherwise may be offensive to minors;
- pyramid schemes, chain letters, junk email, spam, or unsolicited messages;
- material that encourages the use of illegal drugs or influences the use of ammunition, fireworks or any destructive devices or explosives; and
- material that advertises gambling and betting.
When using the Services, you further agree not to:
- defame, abuse, harass, stalk, threaten, bully, or otherwise violate the legal rights of others;
- violate any applicable laws or regulations, or promote or encourage any illegal activity;
- impersonate another User or create a false identity, including but not limited to identities falsely indicating that the User is another user, a celebrity or other well-known person, or a Best Music Coach representative;
- forge email headers or otherwise manipulate identifiers in order to disguise the origin of any content;
- gain or attempt to gain unauthorized access to the Services, to other Users' account or profile information, or to computer systems and/or networks connected to the Website and our other Services;
- make false reports through the Services to Best Music Coach's administrators;
- take any action that imposes or may impose (as determined by Best Music Coach in its sole discretion) an unreasonable or disproportionately large load on Best Music Coach's (or its affiliates' or third party providers') infrastructure;
- engage in fraudulent transactions;
- establish more than one account to participate in our Services;
- use the Services for any form of wagering or gambling;
- transmit any material that you know, or reasonably should know, should not be legally reproduced, displayed, performed and/or distributed in such manner;
- harvest, collect, or store personal information or data of other Users, instructors or our partners;
- use the Services or any Content to train, fine-tune, develop, or improve any artificial intelligence or machine learning model without our prior written consent; and
- performing any circumventing action similar to any of the above.
Best Music Coach reserves the right, but has no obligation, to monitor or become involved in disputes between you and other Users (including the Course's instructor), and exercise common sense and your best judgment when interacting with others, including when you submit or post content or any personal or other information. You also hereby agree that you are responsible for all data charges you incur through use of our Services.
Intellectual Property
Ownership of Intellectual Property
You acknowledge that Best Music Coach owns, or has a license to, all right, title and interest in the "Content" it makes available through the Services.
Except for any rights specifically enumerated as being licensed to you hereunder, Best Music Coach reserves any and all of its rights to the Content. You are only permitted to use the Content as expressly authorized by Best Music Coach.
Ownership of Your Work
Any course work you create, including but not limited to recordings, performances, compositions, projects, assignments, and homework submissions, during your enrollment in a Best Music Coach course is your intellectual property (subject to any underlying copyrights held by third parties in any musical works you perform or arrange). You retain all rights and ownership of your own original work.
Perpetual License for Educational Use
While your work is your own, by enrolling in a Best Music Coach course, you grant Best Music Coach and your course instructor a non-exclusive, royalty-free, perpetual, worldwide license to use, display, share, reproduce, and create derivative works of your projects, recordings, performances, and homework submissions within the class for educational purposes, as well as for promotional purposes related to Best Music Coach and its Services. You understand that you have no expectation of confidentiality for any work or materials you share with Best Music Coach or your instructor. If you wish to keep any information or data private and confidential, it's your responsibility not to include it in your work.
Consent to Class Recordings
ALL SESSIONS ARE RECORDED. By enrolling in any Best Music Coach Course, lesson, or coaching session — including live one-on-one lessons, group lessons, in-person sessions, and online sessions on any platform (such as Zoom, Google Meet, or our own learning environment) — you acknowledge and agree that the session will be recorded by Best Music Coach (audio, video, and/or screen capture) by default and as a routine matter. You should assume every session is being recorded, whether or not a recording indicator is visible.
These recordings may be used for: (i) providing you a reviewable copy for your own practice; (ii) instructor coaching, quality assurance, and dispute resolution; (iii) sharing within your Course cohort or with other enrolled students for educational purposes; (iv) training new instructors; and (v) marketing and promotional purposes (subject to the license below). You grant Best Music Coach permission to record, store, use, reproduce, edit, and distribute these recordings during your enrollment and any subsequent period where Best Music Coach maintains them.
By participating in any recorded session, you grant Best Music Coach an irrevocable, perpetual, royalty-free, worldwide license to use your name, voice, image, likeness, and performance captured in such recordings for any lawful business purpose. You expressly consent to this recording for purposes of any applicable two-party-consent or all-party-consent recording law (including but not limited to those of California, Florida, Illinois, Massachusetts, Pennsylvania, and Washington). If you do not consent to being recorded, you may not participate in our Services. For minors, the supervising parent or guardian provides this consent on the minor's behalf.
Your Restrictions
By use of the Services you acknowledge, agree, and otherwise consent not to engage in, permit another person or entity to engage in, or otherwise be related to or a part of the following restricted activities:
- marketing, sharing, distributing, offering to sell, selling, or otherwise making reproductions or copies of the Website, Services or Content in any way inconsistent with the rights of use provided to you by Best Music Coach herein;
- removing any applicable, relevant identification, copyright, trademark or other notices relating to the intellectual property or other proprietary rights of Best Music Coach;
- attempting to access source or object code of the Website or any Service, by methods including reverse engineering or otherwise reducing it to a form readable without the use of a computer, except and unless any applicable statutes or laws specifically prohibit said restrictive language;
- amending, changing, modifying (including the creation of any derivative or other works) the Website and the Services;
- creating code, software or other program that incorporates any elements of the Website and the Services;
- attempting to hack into, compromise, or otherwise access the object or source code of the Website and the Services for any purposes, personal or commercial; and
- interrupting or attempting to interrupt the operation of the Website and the Services in any way.
Rights relating to your Submitted Content
If Best Music Coach provides you the ability to submit your own content to the Services (such content, which shall include the User Comments and your music recordings, shall hereinafter be referred to as "User Submitted Content"), you shall be deemed as the owner of User Submitted Content (subject to any third-party rights in underlying works). It is your obligation to ensure that your provided User Submitted Content does not infringe any third-party rights, and you agree to be liable for such infringement and indemnify Best Music Coach against any third party claims.
Best Music Coach does not claim ownership rights in any User Submitted Content that you may submit or offer through the Services. However, to the extent you submit any User Submitted Content, you acknowledge and agree that you automatically grant (and represent and warrant that you have the right to grant) an irrevocable, perpetual, non-exclusive, fully paid-up, royalty-free, transferable, sublicensable, worldwide license to Best Music Coach to:
- use, reproduce, distribute, remove, and analyze any of your User Submitted Content as Best Music Coach may deem necessary or desirable for any purpose in connection with the operation of the Services;
- copy, modify, and reproduce your User Submitted Content for marketing, promotional and/or other purposes in connection with Best Music Coach or the Services in any media;
- use, edit, modify, reproduce, distribute, prepare derivative works of, display, post or otherwise make available your User Submitted Content in connection with any feature of the Services;
- delete any or all of your User Submitted Content from the Services, whether intentionally or unintentionally, for any reason or no reason, without any liability of any kind to you or to any other party; and
- enable the Services or Users of the Services to share or post your User Submitted Content on third party sites, such as, without limitation, on social networking sites.
To the extent that you submit, via the Services or otherwise, any unsolicited concepts, ideas, or suggestions (collectively, the "Ideas") for, by way of example and without limitation, any features or functionality for the Services, you agree that such Ideas are non-confidential and non-proprietary, and Best Music Coach shall not be liable for the disclosure of such Ideas. You hereby grant and agree to grant Best Music Coach, under all of your rights in the Ideas, an irrevocable, perpetual, non-exclusive, fully paid-up, royalty-free, transferable, sublicensable, worldwide license to incorporate, use, publish and exploit such Ideas for any purpose whatsoever, commercial or otherwise, including but not limited to incorporating it in the Services, or any Best Music Coach product or service, without compensation or accounting to you and without further recourse by you.
Limitation of Liability; Disclaimer
Best Music Coach and its affiliates, subsidiaries, officers, directors, members, managers, stockholders, employees, instructors, licensors, distributors, sublicensees, agents or subcontractors (collectively, the "Best Music Coach Parties") will do our utmost to ensure that availability of the Services will be uninterrupted and that transmissions will be error-free. However, due to the nature of the internet, this cannot be guaranteed.
YOU EXPRESSLY AGREE THAT THE USE OF THE SERVICES IS AT YOUR SOLE RISK. ALL MATERIALS AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OR THE WARRANTY OF NON-INFRINGEMENT. WE MAKE NO WARRANTY THAT (A) OUR SERVICES WILL MEET YOUR REQUIREMENTS, (B) THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (C) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICES WILL BE EFFECTIVE, ACCURATE OR RELIABLE, AND/OR (D) THE QUALITY OF ANY SERVICES OR INFORMATION OBTAINED BY YOU THROUGH THE SERVICES WILL MEET YOUR EXPECTATIONS OR BE FREE FROM MISTAKES, ERRORS OR DEFECTS.
Instructor Relationship
Best Music Coach engages instructors through a combination of employment and independent contractor relationships. Some instructors are employees of Best Music Coach, LLC (W-2), and others are independent contractors who provide instruction through our platform (1099). Regardless of classification:
- Each instructor is solely responsible for their own teaching style, methods, and conduct during lessons.
- Best Music Coach is not liable for the personal acts or omissions of any instructor that fall outside the scope of services rendered through the Services.
- Independent-contractor instructors are not employees, agents, or partners of Best Music Coach for any purpose other than as expressly stated, and have no authority to bind Best Music Coach.
- All instructors agree to abide by our internal Code of Conduct and these Terms of Use as a condition of providing services through the platform.
WE DO NOT REVIEW OR EDIT THE CONTENT OF OUR INSTRUCTORS' COURSES FOR LEGAL OR OTHER ISSUES. WE DO NOT EXERCISE ANY EDITORIAL CONTROL OVER THE COURSES THAT ARE AVAILABLE ON OUR WEBSITE AND, AS SUCH, DO NOT GUARANTEE IN ANY MANNER THE RELIABILITY, VALIDITY, ACCURACY OR TRUTHFULNESS OF THE COURSES. WE ARE NOT RESPONSIBLE OR LIABLE FOR ANY INTERACTIONS BETWEEN INSTRUCTORS AND USERS WHO PARTICIPATE IN THE COURSE. WE ARE NOT LIABLE FOR DISPUTES, CLAIMS, LOSSES OR DAMAGE OF ANY KIND THAT MIGHT ARISE OUT OF OR RELATE TO THE CONDUCT OF INSTRUCTORS OR USERS.
BY USING THE SERVICES, YOU MAY BE EXPOSED TO CONTENT THAT YOU CONSIDER OFFENSIVE, INDECENT OR OBJECTIONABLE. THE BEST MUSIC COACH PARTIES HAVE NO RESPONSIBILITY TO KEEP SUCH CONTENT FROM YOU AND NO LIABILITY FOR YOUR ACCESS OR ENROLLMENT IN ANY COURSE, TO THE EXTENT PERMISSIBLE UNDER APPLICABLE LAW.
BEST MUSIC COACH MAKES NO COMMITMENT TO UPDATE ITS SERVICES. WE HAVE NO RESPONSIBILITY OR LIABILITY FOR THE DELETION OR FAILURE TO STORE ANY DATA OR OTHER CONTENT MAINTAINED OR UPLOADED BY THE SERVICE. BEST MUSIC COACH RESERVES THE RIGHT TO TERMINATE USER ACCOUNTS THAT ARE INACTIVE FOR AN EXTENDED PERIOD OF TIME. WE RESERVE THE RIGHT TO MODIFY, TEMPORARILY OR PERMANENTLY, THE SERVICE (OR ANY PART THEREOF) WITH OR WITHOUT NOTICE. YOU AGREE THAT WE WILL NOT BE LIABLE TO YOU OR TO ANY THIRD PARTY FOR ANY MODIFICATION, SUSPENSION OR DISCONTINUANCE OF THE SERVICE.
THE DISCLAIMERS OF LIABILITY CONTAINED IN THIS SECTION APPLY TO ANY DAMAGES OR INJURY CAUSED BY ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DELETION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS, COMMUNICATION LINE FAILURE, THEFT OR DESTRUCTION OR UNAUTHORIZED ACCESS TO, ALTERATION OF, OR USE OF THE WEBSITE AND SERVICES, AS WELL AS ANY PHYSICAL INJURY, HEARING DAMAGE, VOCAL DAMAGE, OR INSTRUMENT DAMAGE RESULTING FROM YOUR PARTICIPATION IN MUSIC INSTRUCTION OR PRACTICE, WHETHER FOR BREACH OF CONTRACT, TORTIOUS BEHAVIOR, NEGLIGENCE, OR UNDER ANY OTHER CAUSE OF ACTION.
IN NO EVENT SHALL THE BEST MUSIC COACH PARTIES BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, COMPENSATORY, ACCIDENTAL, CONSEQUENTIAL, PUNITIVE, EXEMPLARY, UNINTENTIONAL DAMAGE (INCLUDING LOST PROFIT, LOSS OF GOODWILL, OR LOST DATA), AND/OR DAMAGE TO YOUR BUSINESS REPUTATION, OR ANY DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, THOSE RESULTING FROM LOSS OF USE OR DATA, WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND ON ANY THEORY OF LIABILITY, ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE SERVICES.
BECAUSE SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR THE LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, IN SUCH STATES OR JURISDICTIONS, THE LIABILITY OF THE BEST MUSIC COACH PARTIES SHALL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.
You fully accept the risks associated with your use of the Services. You acknowledge and agree that your exclusive remedy for any dispute with Best Music Coach Parties is to stop using the Services. You further agree that in no case shall any liability of the Best Music Coach Parties towards you exceed the amount, if any, that you paid for the Services giving rise to any such liability in the twelve (12) months preceding the event giving rise to the claim.
You agree that any claim you may have arising out of or related to your relationship with Best Music Coach must be filed within one year after such claim arose; otherwise, your claim is permanently barred.
Indemnification
You agree to defend, indemnify, and hold the Best Music Coach Parties harmless from all liabilities, claims, losses, costs and expenses, including reasonable attorney's fees, that arise from:
- your use of, or activities in connection with the Services, or those of any under-age person authorized by you;
- any violation of this Agreement by you or any under-age authorized by you; or
- any allegation that any content that you made available via the Services infringes or otherwise violates the copyright, trademark, trade secret, privacy or other intellectual property or other rights of any third party.
Best Music Coach reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with Best Music Coach in asserting any available defenses.
Dispute Resolution; Arbitration; Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY HEAR YOUR CLAIMS.
You and Best Music Coach agree that any dispute, claim, or controversy arising out of or relating to these Terms of Use or your use of the Services (each, a "Dispute") shall be resolved through binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, except that either party may bring an individual action in small claims court for disputes within that court's jurisdiction. The arbitration shall take place in the State of Delaware, or another mutually agreed location, or by videoconference. The arbitrator's decision shall be final and binding.
Class Action Waiver. YOU AND BEST MUSIC COACH AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.
30-Day Opt-Out. You have the right to opt out of this arbitration agreement and class action waiver by notifying us in writing at lessons@bestmusiccoach.com within thirty (30) days of first accepting these Terms of Use. Your notice must include your name, address, and a clear statement that you wish to opt out.
This section does not preclude either party from seeking injunctive or other equitable relief in any court of competent jurisdiction for actual or alleged infringement, misappropriation, or violation of intellectual property rights.
Third Party Websites
The Services may link you to other websites or otherwise include references to information, materials and/or services provided by other parties. These other websites and parties are not under Best Music Coach's control, and you acknowledge that Best Music Coach is not responsible for the accuracy, copyright compliance, legality, decency, or any other aspect of the content of such websites, and nor is Best Music Coach responsible for errors or omissions in any references to other parties or their products and services. The inclusion of such a link or reference is provided merely as a convenience and does not imply endorsement of, opinion of, or association with, the website or party by us, or any warranty of any kind, either expressed or implied.
Advertisements
Our Services may, at some point, include advertisements which may be targeted to the content or information on the Services, queries made through the Services, or from other information. The types and extent of advertisements on the Services are also subject to change over time. In consideration of our providing you with the Services, you agree that we and our third party providers and partners may place advertisements on our Services or in connection with the display of content or information on our Services. The manner, mode and extent of such advertising and promotions are subject to change without specific notice to you.
You may also review our Privacy Policy which explains the procedures that we conduct with respect to advertisements on our Services.
A Note About Children
Our Services are designed for Users 18 years and older. We do, however, welcome minors between the ages of 10 and 17, provided that a parent or legal guardian opens and manages the User Account on the minor's behalf, agrees to these Terms of Use, supervises the minor's participation, and assumes full responsibility for the minor's conduct and use of the Services. We do not knowingly create accounts for or provide Services to children under the age of 10.
In compliance with the Children's Online Privacy Protection Act (COPPA) and similar laws, we do not knowingly collect personally identifiable information directly from children under 13. Where Services are used by a child between 10 and 13 through a supervising adult's account, all personal information is provided and managed by the supervising parent or guardian, who is responsible for the minor's interactions with the Services. Our handling of personal information is described in our Privacy Policy.
If you believe we have inadvertently collected personal information from a child under 13 without verified parental consent, please contact us at lessons@bestmusiccoach.com and we will delete such information promptly.
Testimonials, Reviews, and Endorsements
Any testimonials, student reviews, success stories, before-and-after recordings, or endorsements published on our Website or in our marketing materials reflect the genuine experiences and opinions of the individuals who provided them. Consistent with the FTC's Guides Concerning the Use of Endorsements and Testimonials in Advertising (16 C.F.R. Part 255):
- Best Music Coach does not pay students or other Users to provide testimonials or reviews.
- We do not edit testimonials in a way that materially changes the substance or meaning of what was said.
- Individual results vary. Testimonials describe one student's experience and are not a guarantee, promise, or prediction of the results any other student will achieve. Musical progress depends on many factors, including practice time, prior experience, and individual aptitude.
- If we ever publish a testimonial or endorsement from a person who received any material connection (such as a free product, discounted lesson, or other consideration), we will disclose that connection clearly and conspicuously alongside the testimonial.
- By submitting a testimonial, review, recording, performance, or any other content to Best Music Coach, you grant us the rights described in the "Rights relating to your Submitted Content" and "Consent to Class Recordings" sections above, including the right to use your name, voice, image, likeness, and performance in marketing and promotional materials.
If you believe any testimonial published on our Services is inaccurate or you wish to withdraw a testimonial you previously provided, contact us at lessons@bestmusiccoach.com.
Accessibility

Use of Mobile Devices
Some of the services provided by Best Music Coach may be accessed and used through a compatible mobile device. By accessing and using our Services through a compatible mobile device, you hereby agree that you shall be solely responsible for obtaining the requisite hardware and software that will allow you to use our Services on the said device, including all applicable changes, updates and fees (to the extent applicable).
Best Music Coach does not make any warranties or representations of any kind, with respect to the:

- failure to transmit any data, communications or settings connected with the services provided by Best Music Coach.
Best Music Coach may, from time to time, provide you with automatic notifications relating to your User Account. Some of the alerts may be turned on by default in certain Services. In case you wish to deactivate, reactivate and/or customize alerts, you shall refer to the "Settings" page (or any similar page) of your compatible device.
We will make commercially reasonable efforts to provide the notifications in a timely manner, however Best Music Coach cannot guarantee the time of delivery of the notifications. You acknowledge and agree that Best Music Coach cannot guarantee the time of the delivery of the alerts, as well as their content, and therefore you hereby relinquish any claim against Best Music Coach with respect to the failure to deliver, delay and/or any error in the content of the alert. Furthermore, you hereby acknowledge and agree that we shall not be liable for any action taken or not taken by you or any third party in reliance on a notification.
Suspension and Termination of the Services
Although it is Best Music Coach's intention for the Services to be available as much as possible, there will be occasions when the Services may be interrupted, including, without limitation, for scheduled maintenance or upgrades, for emergency repairs, or due to failure of telecommunications links and/or equipment.
Best Music Coach reserves the right to terminate, suspend, or change any service or feature of the Services at any time, for any reason or no reason, with or without notice to you.
Additionally, Best Music Coach may terminate and/or suspend your use of the Services for violation of these Terms of Use or violation of any other policy related to Services (including the policies of affiliates accessible by the Services). Without limiting the foregoing, your access to the Services may be terminated without warning if Best Music Coach believes, in its sole discretion, that you are under the age of ten (10) years, or that you are a minor under 18 without an appropriately supervising parent or guardian, or for any chargeback or fraudulent payment activity as described above. You agree that Best Music Coach shall not be liable for any loss or damage caused, directly or indirectly, by any such termination, suspension, or change and you will have no further access to the Services and shall have no right to any refund of any monies paid to Best Music Coach.
Technical Support
If you are having a technical problem with the Services, including any Application, you may ask for technical support by writing to lessons@bestmusiccoach.com. When writing to us, please be sure to tell us which Course(s) you subscribed for. We'll do our best to help you solve any technical problem, but we don't warrant, and specifically disclaim, that we will be able to resolve all technical issues.
Complaints
If you have any complaints, claims or disputes with regard to the Website and/or the Services, you are hereby instructed to submit such complaint to Best Music Coach in writing as soon as is reasonably practicable following the occurrence of the event to which the complaint refers. Complaints may be submitted by email to lessons@bestmusiccoach.com, with maximum description and details.
Assignment
Best Music Coach may assign this Agreement, in whole or in part, at any time. You may not assign, transfer or sublicense any or all of your rights or obligations under this Agreement without Best Music Coach's express prior written consent.
Governing Law
This Agreement (and any dispute or claim arising out of or in connection with it or its subject matter (including non-contractual disputes, claims and the arbitration agreement)) shall be governed by and is to be construed in accordance with the law of the State of Delaware, United States of America, without regard to its conflict-of-laws principles. For any claim not subject to arbitration, you and Best Music Coach consent to the exclusive jurisdiction and venue of the state and federal courts located in Kent County, Delaware.
You shall comply with all applicable laws, statutes, ordinances and regulations regarding your use of the Website and the Services. Although the Services may be accessible worldwide, we make no representation that materials on the Services are appropriate or available for use in locations outside the United States of America, and accessing them from territories where their contents are illegal is prohibited. Those who choose to access the Services from other locations do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable.
Notices
All notices to a party shall be in writing and shall be made either via email or conventional mail. The parties agree that all correspondence relating to this Agreement shall be written in the English language. Notices to Best Music Coach must be sent to the attention of Customer Service at lessons@bestmusiccoach.com, if by email, or to the address below if by conventional mail. Notices to you may be sent to the email or mailing address supplied by you as part of your account or user profile, if any. In addition, we may broadcast notices or messages through the Services to inform you of changes to the Services or other matters of importance, and such broadcasts shall constitute notice to you at the time of sending.

Entire Agreement
This Agreement constitutes the entire agreement and understanding between you and Best Music Coach concerning the subject matter and supersedes all prior agreements and understandings of the parties with respect to that subject matter.
No Waiver
If you breach these Terms or any other of our policies and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these Terms of Use.
Severability
If any part of these Terms of Use is determined to be invalid or unenforceable, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of these Terms of Use shall continue in effect.
Force Majeure
You hereby acknowledge and agree that Best Music Coach shall in no case be liable for any event beyond our reasonable control (including, but not limited to, acts of any government or authority, embargo, revocation of any license or consent, failure of any power supply, theft, malicious damage, acts of war, terrorism, natural disasters, pandemics, internet outages and such other force majeure occurrences).
Survival
Any provision of this Agreement that, by its nature, is intended to survive the termination of your User Account, your subscription, or this Agreement will continue in full force and effect after such termination. This includes, without limitation, the following sections: Representation of Identity and Academic Integrity; Music Instruction Disclaimers and Assumption of Risk; Music Copyright and User Recordings (including DMCA Notice and Takedown); Fees, Subscriptions, and Auto-Renewal (including Chargebacks) with respect to amounts already owed; Intellectual Property (including Ownership of Intellectual Property, Perpetual License for Educational Use, Consent to Class Recordings, and Rights relating to your Submitted Content); Limitation of Liability and Disclaimer; Indemnification; Dispute Resolution; Arbitration; Class Action Waiver; Governing Law; Notices; Entire Agreement; No Waiver; Severability; Force Majeure; this Survival section; and Miscellaneous.
Miscellaneous
Nothing in this Agreement shall be construed as creating any agency, arrangement, partnership, joint venture, trust or fiduciary relationship, employer-employee relationship or any other similar relationship between you and Best Music Coach.
Nothing contained in this Agreement is in derogation of our right to comply with governmental, court, and law enforcement requests or requirements relating to your use of the Services or information provided to or gathered by Best Music Coach with respect to such use. Any heading, caption or section title contained herein is inserted only as a matter of convenience, and in no way defines or explains any section or provision hereof.
